These Terms of Service ("Terms") govern your use of the Wine Not At The Trails, LLC mobile application ("App") and related services. By downloading, installing, or using our App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our App.

Acceptance of Terms
By accessing or using our App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and Wine Not At The Trails, LLC.
Important Notice
If you do not agree to these Terms, you must immediately stop using our App and delete it from your device. Continued use of the App constitutes acceptance of any modifications to these Terms.
App Description
The Wine Not At The Trails, LLC App is a mobile application that allows users to:
User Accounts
Account Creation
- •You must provide accurate and complete information when creating an account
- •You are responsible for maintaining the confidentiality of your account credentials
- •You must be at least 13 years old to create an account
- •One person may not maintain multiple accounts
Account Security
- •You are responsible for all activities that occur under your account
- •Notify us immediately of any unauthorized use of your account
- •We are not liable for any loss or damage arising from unauthorized account use
Payment Terms
Payment Processing
- •All payments are processed securely through third-party payment processors
- •We accept major credit cards and digital payment methods
- •Payment information is encrypted and not stored on our servers
- •All prices are in USD and include applicable taxes
Refunds and Cancellations
- •Reservations may be cancelled up to 2 hours before the scheduled time
- •Food orders may be cancelled within 15 minutes of placement
- •Refunds are processed within 5-7 business days
- •No refunds for completed services or consumed items
Prohibited Uses
You agree not to use our App for any unlawful purpose or any purpose prohibited under this clause. You may not use the App in any manner that could damage, disable, overburden, or impair our servers or networks, or interfere with any other party's use and enjoyment of the App.

- • Violating any applicable laws or regulations
- • Transmitting malicious code or viruses
- • Attempting to gain unauthorized access
- • Impersonating another person or entity
- • Harassing or threatening other users
- • Spamming or sending unsolicited messages
Content Restrictions
- • Posting offensive or inappropriate content
- • Infringing on intellectual property rights
- • Sharing false or misleading information
- • Promoting illegal activities
- • Violating privacy of others
- • Commercial use without permission
Intellectual Property
Our Rights
The App and its original content, features, and functionality are and will remain the exclusive property of Wine Not Trails Restaurant and its licensors. The App is protected by copyright, trademark, and other laws.

User Content

Service Availability
We strive to provide continuous service, but we do not guarantee that the App will be available at all times. We may experience downtime for maintenance, updates, or technical issues.
Accuracy of Information
While we strive to provide accurate information about our menu, prices, and services, we cannot guarantee that all information is current or error-free. Prices and availability are subject to change without notice.
Third-Party Services
Our App may integrate with third-party services. We are not responsible for the availability, content, or privacy practices of these third-party services.
Limitation of Liability
To the maximum extent permitted by law, Wine Not At The Trails, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the App.
Important: Our total liability to you for any damages arising from or related to these Terms or the App shall not exceed the amount you paid us for the App in the 12 months preceding the claim, or $100, whichever is greater.
Termination
Termination by You
You may terminate your account at any time by contacting us or using the account deletion feature in the App. Upon termination, your right to use the App will cease immediately.
Termination by Us
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Governing Law
These Terms shall be interpreted and governed by the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of Volusia County, Florida.
Dispute Resolution: Before filing any formal legal proceedings, we encourage you to contact us first to try to resolve the dispute informally. We are committed to working with you to resolve any issues.
Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the App.
